Though cocaine, for example, is also taxed; that's not usually considered a harmless soft drug.

Drugs seized without stamps or having expired stamps may result in criminal or civil penalties which may include fines, seizure of property or liens against real estate.
But since the possession of drugs is illegal, a valid stamp won't protect the owner from any of these penalties, would it?

I'm not a lawyer.

One opinion I saw is that penalties for tax evasion are higher than for possession of drugs (especially "soft" drugs in small quantities), so by instituting a tax they get not only higher revenues but can "nail" people more effectively if they catch them.

And I'm not sure they can seize the non-drug property of a drug dealer just for dealing drugs, or place a lien against real estate, preventing them from selling it.

It's the same in North Carolina. Remember the way they got the gansters during prohibition was not possession of alcohol but non-payment of tax.
